Main Terms
Before We Start: Thank you for partnering with me in this process. I'm looking forward to helping you and your family get more and better sleep. In these Terms & Conditions, there are some agreements that I would like to make with you before we start our collaboration. Don't be alarmed, it's not complicated, and I've tried to write it in plain language. Please take a moment to read through this document, and if you agree with everything, we can get started!
The Goal: My goal is to help your child have safe, stress-free, quality sleep (and to help you get more of that stress-free, quality sleep, too!).
What I expect from you: I encourage you to take your time reading through the sleep plan I have created. In addition, it is important that both partners read this and that you work together in this journey as much as possible. I will walk you through this plan in our call, and I expect you to provide me with accurate and honest information about your child's sleep habits and be consistent and actively participate in the process.
What You Can Expect from Me: I will be here as your partner, coach, and cheerleader. You can email/text me every day within the agreed-upon time frame/agreed-upon amount (based on which package you purchase) with as many questions and concerns as you'd like. I will respond to you within 6 hours (if sent within regular business hours—9:00 AM-5:00 PM, Monday-Friday, varied availability on the weekends and holidays). I will still respond outside of regular business hours; however, it may take longer for me to respond.
Confidentiality: Your personal information and consultation details will be kept confidential, except in cases where disclosure is required by law.
Payments & Refund: I will start working on the sleep plan only after the complete payment has been made. Please note that once the payment for the sleep plan is made, the payment is non-refundable. If you do not begin to implement the sleep plan within 3 months of the training call, you may be charged a $50 fee for me to update the plan, if needed. If you plan to seek reimbursement through your Health Savings Account (HSA) or Flexible Spending Account (FSA) provider for the purchase of your package, it is your responsibility to make sure that my services are considered an eligible expense.
Limitations: My sleep advice is based on my professional training and experience working with families. While I will offer professional sleep advice, it is important to understand that I cannot guarantee specific outcomes or results. It's essential to acknowledge that individual results may vary.
Disclaimer: Counting Sleep with Courtney, LLC does not offer medical advice, services, or treatment to its clients. If you are concerned about a medical issue related to your child, I urge you to consult a doctor or pediatrician immediately. I recommend you discuss this plan with your pediatrician. If you have medical questions regarding your child, always contact your pediatrician right away. If, during our intake process, I identify potential signs of underlying medical conditions (such as sleep apnea or other health concerns), you are responsible for following up with your pediatrician before beginning sleep training. Sleep consulting services will not commence until you have received appropriate medical clearance when indicated. While I respect each family's individual sleep preferences, when you choose to work with Counting Sleep with Courtney, LLC, you agree to follow all safe sleep guidelines laid out by the American Academy of Pediatrics (AAP). Parents remain fully responsible for all decisions regarding their child's care and well-being.
Linked Websites: I am not responsible for the contents of any linked sites on this website or in any materials. The inclusion of any link does not imply endorsement by Counting Sleep by Courtney, LLC. Use of any linked website is at the user's own risk.
Cancellation and Rescheduling: Please be aware that if you fail to provide a 24-hour advance notice of cancellation for a scheduled appointment, it may result in additional charges, to the extent permitted by applicable local law.
Intellectual Property: Ownership of all materials, resources, and tools provided as part of my sleep consulting services remains with Counting Sleep with Courtney, LLC. You are strictly prohibited from sharing, reproducing, or distributing the sleep plan or any associated materials to third parties without my prior written consent.
DMCA Policy and Copyright Protection
As a sleep consulting business, I create original content, including sleep plans, educational materials, guides, and other proprietary resources. These materials are protected by copyright law, and I take intellectual property rights seriously.
Copyright Ownership: All content on this website and in my sleep consulting materials, including but not limited to sleep plans, guides, educational content, images, text, and downloadable resources, is owned by Counting Sleep with Courtney, LLC or used with proper authorization. This content is protected by United States and international copyright laws.
Prohibited Uses: You may not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content from my website or sleep consulting materials without my express written permission. This includes sharing sleep plans with other families, posting my materials on social media or other websites, or using my content for commercial purposes.
DMCA Takedown Notice Procedure: If you believe that content on my website or in my materials infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA). Your notice must include:
Your contact information: Full name, phone number (if available), and email address
Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed
Identification of the infringing material: A description of where the allegedly infringing material is located on my website or in my materials, with enough detail for me to locate it

Counter-Notification Procedure: If you believe that content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
Your contact information (name, phone, email)
Identification of the material that was removed and its location before removal
A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of a mistake or misidentification
A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which you are located, or if outside the US, any judicial district in which I may be found
Your physical or electronic signature
Repeat Infringer Policy: I maintain a policy of terminating services to users who are repeat copyright infringers when appropriate and at my sole discretion.
Reporting Copyright Infringement by Others: If you discover that someone else is using my copyrighted materials without authorization (such as sharing sleep plans or other proprietary content), please notify me immediately so I can take appropriate action to protect my intellectual property rights.
Medical Consultation and Clearance Policy
Important Health and Safety Requirement: During our intake process, I carefully review your child's sleep patterns and behaviors to ensure sleep training is appropriate and safe. If I identify any potential signs that could indicate underlying medical conditions affecting sleep, I will recommend that you consult with your pediatrician before we begin sleep training.
Your Responsibilities: If I recommend a pediatrician consultation, you agree to:
Follow Through Promptly: Contact your pediatrician within a reasonable timeframe to discuss the concerns I've identified
Obtain Medical Clearance: Get written or verbal confirmation from your pediatrician that it is safe to proceed with sleep training
Inform Me of Results: Let me know what your pediatrician recommends before we begin our work together
Delay Services if Needed: Understand that sleep consulting services will be postponed until appropriate medical evaluation and clearance is obtained
Why This Matters: Certain medical conditions, such as sleep apnea, can significantly impact a child's sleep and may require medical treatment before behavioral sleep training can be effective or safe. Your child's health and safety are the top priority.
No Medical Diagnosis: Please understand that I am not diagnosing any medical conditions. I am simply identifying patterns that warrant professional medical evaluation. Only qualified medical professionals can diagnose and treat medical conditions.
Acknowledgment: By proceeding with sleep consulting services, you acknowledge that:
You understand the importance of following through on any pediatrician consultation recommendations
You accept full responsibility for your child's medical care and any decisions related to their health
You will not hold Counting Sleep with Courtney, LLC, liable for any consequences if you choose not to follow pediatrician consultation recommendations
You understand that sleep training may need to be delayed or modified based on medical findings
Testimonials and Marketing
Use of Your Feedback: By working with Counting Sleep with Courtney, LLC, you grant me permission to use your feedback, testimonials, and success stories for marketing and promotional purposes. This includes, but is not limited to:
Written testimonials and reviews you provide
Screenshots of text messages, emails, or other communications where you share positive feedback about our work together
Screenshots of sleep tracking logs and data from apps we use during our work together
Before/after sleep improvement stories and data comparisons
General success metrics (such as "improved sleep by X hours")
Family photos you choose to provide (photos are always optional and never required)
I may edit testimonials for length, clarity, or grammar while maintaining the original meaning.
Privacy Protection: When using your feedback for marketing purposes, I will:
Use your first name and last name initial for attribution (e.g., "Sarah M.")
Include your child's age when relevant to the testimonial, but never your child's name unless you specifically provide it in your testimonial
Remove or block out any other personally identifying information, such as phone numbers, addresses, or specific family details
Protect any private details about your family's specific situation
Focus on sleep outcomes rather than personal family information
How Your Testimonials May Be Used: Your testimonials and feedback may appear on:
My website and blog
Social media platforms (Instagram, Facebook, etc.)
Email newsletters and marketing materials
Professional presentations or case studies (with all identifying information removed)
Online reviews and testimonial collections
Your Rights: You may request that specific testimonials or feedback be removed from my marketing materials by contacting me directly.
Understanding Public Sharing: You understand that once testimonials are shared publicly (such as on social media), they may be seen and shared by others.
No Compensation: You understand that no compensation is provided for the use of your testimonials, and this permission is granted as part of our service agreement. Occasionally, I may offer small incentives (such as gift cards) as a thank-you for providing testimonials, but this is not guaranteed and is provided at my sole discretion.
Additional Terms
Indemnification: To the extent permitted by applicable local law, you agree to hold Counting Sleep with Courtney, LLC harmless and indemnify me from any liability that may arise from your participation in my sleep consulting services.
Electronic Signatures: This agreement may be signed electronically or with a physical signature. By signing this agreement electronically, you acknowledge that your electronic signature is legally binding and has the same force and effect as a handwritten signature. Physical signatures are equally valid and acceptable.
Governing Law: The terms and conditions of these sleep consulting services shall be governed by and construed in accordance with the laws of Indiana.
